#6, That's an overused analogy. There's a difference between shouting "fire" in an attempt to create a panic and making a joke about someone else killing the president.
The limitation on speech, as with on any other right, begins when it directly endangers or infringes on the rights of another.
Hell, I'm not saying they wouldn't try to arrest somebody for it....the way our government works right now they probably would. I'm just saying there would be a reasonable defense.

#9, Legitimate threats, yes. But making a joke about someone else firing a rocket launcher at his limo?
Ehh, I dunno. All kinds of crazy ins and outs in the legal system. I've always wondered that if a cop threatens me, and I pull a legally concealed firearm on him and make a citizen's arrest for his threat, would that be legal? |

#12, Then of course, there are other issues. Naturally the cop would probably attempt to draw his own weapon, at which point would the citizen be justified in firing? Then there are other ins and outs....whether or not the citizen makes a verbal warning upon pulling his weapon, whether or not the shot is a deliberate non-letal (in the leg, for example), etc.
This dilemma creeped upon me a few months ago when I saw a cop act threateningly to a citizen on one of those police video shows, and it's been bugging me ever since. |
