When fascism comes to America, it will come under the guise of patriotism. |

Fascism and Patriotism go hand in hand... that's the appeal

what? just because you don't agree with them they still have the right to think that way, there always are people who oppose war, and with good reason good people die in wars and generaly bad things happen but it is a unavoidable aspect of human nature. |

There's also a semi-legitimate reason they were arrested. They weren't doing anything particularly bad, but they were wearing the shirts in the same shopping mall where they originally purchased them. The mall had a policy (which was posted in a visible location) that "apparel likely to cause public disruption" was not allowed. Thus, mall security asked them to leave. They refused, so the police arrested them for trespassing (since they stayed without the consent of the property owner).
I'm not trying to put any particular slant on this; I really don't care--it's their right to protest. Although they have a right to public free speech, an important fact remains that these people were doing this on private property and were subject to the rules set by its owner. Whether this rule was contrary to public policy is, however, open for discussion. |

#7, A shopping mall is considered a public place, even when privately owned. |

#8, Which is where we get into issues over whether the owner of the mall had the right to establish private rules that run contrary to rights generally protected under the Constitution. |

One wonders is wearing pro-war shirts in the mall would lead to an arrest. Funny that a message of peace is a "disturbance" but a message of war wouldn't be. |

#11, You've got a point there. I'm sort of curious, myself, as to how the situation would've evolved if the facts were changed like that. |

#13, Maybe. As many of those shirts as I see, though, I doubt it.
Then again, my home state naturally tilts to the right. |

I used to be fairly left - even read the Socialist rag 'the People'. But I have swung pretty far right the past few years. Becoming a homeowner, father, and main wage earner has a tendency to do that. But anways, I digress - Freedom of speech is important, but so it the right to regulate it (ie, yelling FIRE in a movie theater).
There is a female basketball player in Detroit who turns away from the flag while they sing the National Anthem.
Does she have the right to do this? Sure. But I don't think it is an appropriate place to make a statement. You can be anti-war, but that does not mean you should be anti-USA. Best thing for her to do would be to stay off court while the Anthem was done, and then go on when it was time to play.
These two jokers were probably saved an ass whoopin' if they ended up running into the wrong crowd, so that could be enough to 'cause a disturbance'. I don't view a store/mall as a public place either, since the property is owned. |

Maybe it isn't a statement? Maybe she just wants to turn away from the flag.
I'm something of a Libertarian....that means I'm against the government doing almost anything. :) |
